Nilfisk Live Auction – Terms & Conditions, 12 September 2025
1. General
- These Terms & Conditions (“T&Cs”) apply to all sales at this live auction.
- Participation in the auction constitutes acceptance of these T&Cs.
- Nilfisk reserves the right to withdraw any lot or refuse any bid at its sole discretion.
2. Description of Goods
- Items may be new, ex-demonstration, or used cleaning machines.
- Ex-demo and used machines are sold strictly “as seen” at the time of the auction.
- Nilfisk operates a grading system to provide guidance on condition. The grading is for guidance only and does not override the “sold as seen” basis of sale.
Grading System
- Grade A – New, has not been used, boxed, no box or box may be damaged.
- Grade B – Very good condition, has had very little use, not boxed.
- Grade C – Average demo machine, well used, approx. 6 months old.
- As Seen – In poor condition or faulty
- Buyers are responsible for inspecting items online and satisfying themselves as to condition and suitability before bidding.
3. Inspection & Due Diligence
- Buyers are strongly advised to inspect machines prior to bidding.
- By bidding, buyers confirm they are satisfied with the condition, grade, and suitability of the item.
- Known issues or damage have been disclosed and pricing reflects this.
4. Bidding & Sale
- The auctioneer’s decision is final and binding.
- Once the hammer falls, the successful bidder is legally obliged to complete the purchase.
- Nilfisk reserves the right to set reserve prices, regulate bidding, and refuse bids.
5. Payment
- Payment must be made in full via account within 10 days of the auction.
- Accepted payment methods: by registered Nilfisk dealer account.
- Title to goods passes only once Nilfisk has received cleared funds in full.
- The £ to € conversion rate is 1.18

- Retain any deposit or payment made as liquidated damages.
9. Governing Law
- These T&Cs shall be governed by and construed in accordance with the laws of United Kingdom, and any disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
10. Trade Buyers Only
The Buyer acknowledges that all sales are made on a business-to-business basis. These Terms and Conditions are intended for trade buyers only and not for consumers. Accordingly, consumer protection legislation (including but not limited to the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013) shall not apply to any sale made under these Terms. By placing an order, the Buyer confirms that they are acting in the course of their trade, business, or profession.
11. Data Protection / GDPR
The Seller will collect and process personal data provided by the Buyer in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Personal data will be used only for the purposes of processing orders, maintaining buyer accounts, and (where consent has been given) providing information about the Seller’s products and services.
The Seller will not share personal data with third parties except where required for order fulfilment or where legally required. The Buyer has the right to access, rectify, or request deletion of their personal data at any time by contacting the Seller.
